Terms of use of the SUPERBAKICI platform

 

1. DEFINITIONS

1.1. Administration. Consists of the people responsible for managing the SUPERBAKICI page. The administrator performs administrative tasks on the SUPERBAKICI page and acts as an intermediary for users. The administrator of Superbakici.com.tr is Family Projects Oy. 02700 Kauniainen, Finland.

1.2. Anonymous user. A person who uses the website's administration services without registering on the website.

1.3. Personal data. Any information that can be used to identify an individual; also any information relating to a previously identified individual.

1.4. Website. www.superbakici.com.tr website managed by the administration.

1.5. Membership fee. A fixed fee determined by the administration. Users paying a fixed fee have the opportunity to use additional functions of the SUPERBAKICI platform.

1.6. Privacy Policy. The procedure presented on the website for the processing of personal data provided by the user to the administration through the website. The SUPERBAKICI platform user agrees to the processing of personal data and confirms that all personal data and information provided by him are correct and true.

1.7. SUPERBABY platform. A system owned, managed and maintained by the administration. The system is hosted on a website where users can find an assistant/service provider (babysitter, house helper, pet sitter or home tutor) or a suitable assistant job.

1.8. Rules. SUPERBAKICI terms of use, legal relations between website users and the administration, and the rules for using the SUPERBAKICI platform, which are regulated by the legal relations between users. Users who want to use the services provided by the administration must accept the rules.

1.9. User. A natural person who is at least 18 years old and registers on the website for the purpose of finding an assistant or employment.

1.10. User profile. This is a record of a user registered on the SUPERBAKICI platform, consisting of personal data entered about him/herself.

 

2. WORKING PRINCIPLES OF THE SUPERCARE PLATFORM

2.1. In the SUPERBAKICI platform, management helps users collaborate. Users can find an assistant, helper can find a job. Management acts as an intermediary between users.

2.2. The administration, which owns the website and the SUPERBAKICI platform, does not act as an assistant and does not seek help. Only users are responsible for entering information into advertisements and providing assistance services.

2.3. Users understand and agree that they are solely responsible for complying with the legislation applicable to their activities. Users of the SUPERBAKICI platform understand that when hiring people and providing services, they may be required to have certain permits and licenses that enable them to comply with the formalities of the employment relationship and to carry out other legal and/or tax procedures stipulated in the legislation of the Republic of Turkey.

2.4. The information and personal data on the website and in advertisements are entered by users, therefore the administration is not responsible for the accuracy and truthfulness of this information, as well as for any damages or possible damages caused by the actions of users, agreements and contracts concluded based on the information displayed on the website.

 

3. REGISTRATION PROCESS AND WEBSITE TERMS OF USE

3.1. An anonymous user can view advertisements and user profiles. The visibility of information in user profiles is limited to anonymous users.

3.2. A person who wants to fully use SUPERBAKICI services must register on the SUPERBAKICI website using one of the following methods:

3.2.1. by filling out the relevant registration form on the website;

3.2.2. By logging in with your Facebook profile.

3.3. The user has the right to add only his/her own photo as the user profile photo. It is prohibited to add graphic images/letters/numbers (e.g. logos, handwritten notes, phone numbers, surnames, keywords) or photos combined with graphic images/letters/numbers or modified in any other way. By uploading photos to the profile, the user confirms that he/she has the right to use photos that do not infringe the rights of third parties.

3.4. Registered users can post advertisements and add information to their user profiles. They can also see more information than anonymous users and exchange private messages with other users (as defined on the website). The full functionality of the page is available to users who pay a membership fee according to a fixed system.

3.5. During registration, the user creates personal login data (username and password) and is obliged to keep the provided data confidential and not to disclose it to third parties. In order to reduce the risk of illegal login on the SUPERBAKICI platform on behalf of the user, it is recommended to create a strong and difficult to guess password (it is recommended that the password consists of at least eight characters, contains both uppercase and lowercase letters, numbers and punctuation marks, and avoids easily guessable words (user's name, surname, etc.) and/or numbers (for example, birthday, etc.)) and the password should be changed at least every six months. The user is responsible for the strength and storage of the login data created by him, as well as for other possible actions performed while logging in to the website using the user's login data (data transfer, offers sent, user comments, etc.). If a third party logs in to the SUPERBAKICI page with the user's login data, the administration considers this person as the user. If the user has lost his login data, he must immediately notify the SUPERBAKICI administration by e-mail or change the login data by logging in to the platform.

3.6. The user is obliged to provide correct, true and detailed data in the registration form. If the personal data provided in the registration form has changed, the user must immediately update them. The administration is not responsible for incorrect or inaccurate personal data entered by the user or third parties, or for personal data that has not been changed or is incomplete.

3.7. The user has the right to change, complete or delete registration data at any time. When the registration is deleted, the user loses the opportunity to fully use the SUPERBAKICI platform. The user can restore the usage options only by re-registering on the SUPERBAKICI page.

3.8. By registering on the website, the user confirms that he/she is at least 18 years old.

3.9. Users who pay the fixed membership fee in advance by following the procedure specified on the website can use the most comprehensive options of the website (scope is defined on the website). Membership is valid for the period for which it is paid, unless early termination of membership is requested according to the rules of procedure.

3.10. The membership is automatically renewed for the period valid at the time of renewal and the relevant payments are automatically collected from the user's bank account unless the user notifies the cancellation of his/her membership or does not wish to renew it before the membership expires.

3.11. The User may cancel their membership at any time using one of the following methods: i) Through the user account on the SUPERBAKICI website ii) By informing the management at [email protected] iii) If the User paid for their membership via Paypal - via the Paypal system. If the User cancels their membership, the membership fee will not be refunded.

3.12. The Administrator has the right to change membership plans and membership fees. Changes will come into effect after the user is notified of the relevant changes.

 

4. RIGHTS AND OBLIGATIONS OF USERS

4.1. SUPERBAKICI platform user must:

4.1.1. not to engage in illegal activities on the website;

4.1.2. to communicate with other users and administration in accordance with universally accepted ethical and moral principles;

4.1.3. to transmit only accurate information to other users and administration and to constantly update their own data.

4.1.4. act fairly, without any intention to deceive any other user and/or organiser;

4.1.4. to change your login data if there is a risk that the data may be acquired by third parties;

4.1.5. Ensure that the information and photo in the User's profile meet moral and ethical requirements and do not infringe anyone's copyright or otherwise cause disputes or for any reason;

4.1.6. To ensure that the information entered i) is suitable for the intended use of the SUPERBAKICI platform; ii) does not promote any person or product without the prior consent of the administration; iii) does not threaten the operation of the SUPERBAKICI platform or database (for example, virus-infected programs or documents).

4.2. The administration has the right to limit the user's ability to use the website, which includes completely removing the user from the website and taking other actions that the administration deems necessary, including, but not limited to, suspending the rights and obligations of the person acting as administrator, if the action or inaction of the administration is necessary for the unconditional operation of the website and/or to ensure the rights of other users.

4.3. The Administration has the right to suspend the user's registration and/or delete the user from the website and/or block the user in the following cases:

4.3.1. If the user has entered or is entering incorrect, false and/or incomplete information;

4.3.2. If the user's behavior with other users does not comply with universally accepted moral principles;

4.3.3. If the user uses the SUPERBAKICI platform to intentionally harm other users and/or the administration;

4.3.4. If the User otherwise violates these rules or applicable laws.

4.4. The administration owns the intellectual rights of the website, domain name (SUPERBAKICI) and operating system. The user is prohibited from saving, copying, moving, transferring and disclosing the content of the website.

 

5. LIMITATION OF LIABILITY

5.1. The Administration cannot and does not have to be held responsible for any damage caused to the user in the event that a third party logs into the SUPERBAKICI platform using the user's login data.

5.2. The Administration is not responsible for third-party advertising, links or cookies on the website. The User must take into account the user agreements and privacy policies of third parties.

5.3. Due to the specific characteristics of the Internet as an external factor, the administration cannot guarantee uninterrupted access to the website. The Organizer may restrict access to the SUPERBAKICI platform in whole or in part if this is necessary for security, server maintenance or other objectively important reasons.

5.4. The administration has the right to change the content or functions of the website without prior notice to users. The administration has the right to change or terminate the provision of services for any reason and without prior notice, including the right to terminate the provision of services with or without prior notice to any user or third party and with liability to users.

 

6. FINAL PROVISIONS

6.1. The administration has the right to change the rules unilaterally and in case of significant changes to the rules, the administration has the right to inform the user about these changes through the website or through the contact information entered by the user. The change in the rules will enter into force within five working days after it is published on the website or notified to the users by e-mail. The change will apply to all users who do not express their disapproval of the change within the specified time period.

6.2. The rules have been prepared in accordance with the laws of the Republic of Turkey.

6.3. The laws of the Republic of Turkey shall apply to the relationships arising from the application of the rules.

6.4. All disputes arising from the application of the rules will be resolved through negotiations. In case of failure to reach an agreement, the disputes will be resolved in the courts of the Republic of Turkey in accordance with the procedure specified in the legislation.

PRIVACY POLICY

 

1. PURPOSE OF THE PRIVACY POLICY

1.1. This privacy policy explains the rights of users and the principles and purposes of processing personal data on the website.

1.2. A privacy policy has been established and personal data entered into the website is managed in accordance with the requirements set by the laws and regulations of the Republic of Turkey.

1.3. By entering personal data on the website, the user accepts that his personal data will be managed in accordance with the procedure specified in this privacy policy.

 

2. DEFINITIONS

2.1. Different terms are used in this privacy policy. The meanings of the terms are explained below:

Personal data or data is any information relating to an identified or directly or indirectly identifiable user (data subject).

Data processing is any operation or set of operations performed using automatic or non-automatic means and by which personal data or part of personal data is processed (for example, data collection, storage, sorting, systematization, storage and other operations).

Personal data processor is the natural or legal person who processes personal data on behalf of the data controller.

The controller manages the website, and its address is www.superbakici.com.tr.

SUPERBABY platform. A system managed and administered by the Controller. The system is located on a website that allows platform users to find suitable work as assistants (babysitters, house helpers, pet sitters, home tutors or other helpers) or helpers.

The privacy policy is this privacy policy that sets out the basic rules for the data controller resulting from the collection, accumulation, management and storage of data and applies to users of the website.

Regulation means Regulation 2016/679, which entered into force throughout the European Union on 25 May 2018. The Regulation deals with the protection of personal data of natural persons through the management of personal data and the free movement of such data; by means of the Regulation, Directive 95/46/EC is deemed null and void.

User is the natural person who visits the website of the controller and registers on the website by entering personal data.

 

3. PROCESSING OF PERSONAL DATA

3.1. A person wishing to register on the website must provide the controller with the following personal data (in other cases, the user may provide): i) name, surname; ii) date of birth; (iii) gender; iv) e-mail address; v) telephone number; vi) location/place of service provision; vii) photo; viii) data obtained when connecting to a Facebook profile. In addition, the data processor processes other personal data. The relevant data was entered by the user by posting ads on the SUPERBAKICI platform or by other means.

3.2. The controller has the right to use non-personal data of users for data analysis purposes using various statistical methods in order to perform statistical and financial analyzes, improve the quality of service, etc. The controller has the right to disclose the results of such non-personal statistical analyzes and use them for marketing and other purposes.

3.3. The controller may also use cookies on the website, which are used to analyse the characteristics of the use of the website, user behaviour or automatically compiled visit statistics.

3.4. The controller also processes personal data of the purchased membership and activities on the SUPERBAKICI platform.

 

4. PURPOSES OF PROCESSING PERSONAL DATA

4.1. Personal data entered by users are processed for the following purposes:

4.1.1. Provision of services. The controller collects personal data of users and uses them to mediate helpers and those seeking helpers on the SUPERBAKICI platform.

4.1.2. Improvement of the Website. The controller collects data on website usage statistics and users' behavior in order to evaluate the functionality of the website and improve the accessibility of services and increase ease of use.

4.1.3. Contact. The controller may contact users and answer their questions.

4.1.4. Direct marketing. If the user agrees to receive offers and news, the controller uses personal data to send the user offers and information (e.g. general newsletters, information about offers, news, discounts, requests for opinions on the services offered). The user has the right to refuse to receive offers at any time and can withdraw his consent at any time. Refusing offers does not prevent the user from using the SUPERBAKICI platform.

4.1.5. User identification. User personal data is used to identify the user and ensure that the person is not under 18 years of age.

 

5. DISCLOSURE OF PERSONAL DATA

5.1. The User confirms that he understands that the personal data entered during registration and in advertisements are publicly available to other persons.

5.2. The data controller ensures that users' personal data are not sold, used or otherwise transferred to third parties without a legal basis and are not used for purposes other than those for which the data was collected. The controller only transmits data in accordance with this privacy policy and the laws of the Republic of Turkey.

5.3. In addition to the situations specified in the privacy policy, the data controller may transfer users' personal data to third parties only in the following cases:

5.3.1. Data controller for service providers (accounting and IT service providers, lawyers, courts, bailiffs, debt collection companies, database administrators, etc.) who cannot find the user's data due to the specifics of the services they provide.

5.3.2. If the user gives separate consent to the transfer of data;

5.3.3. In cases prescribed by law and if necessary to achieve the objectives stated in this privacy policy;

5.3.4. Data transfer is mandatory when requested by law enforcement authorities in accordance with the procedure specified in the legislation of the Republic of Turkey;

5.3.5. In other cases based on the legislation of the Republic of Turkey.

 

6. USE OF COOKIES

6.1. The controller may use cookies on the website. Cookies are text files with a unique identification number that are saved on the hard drive of the user's computer by the website, so that the controller can distinguish the user's computer and see their activity on the website.

6.2. With the help of cookies, the controller collects the following personal data: web browser type, demographic data, IP address, etc.

6.3. The controller uses the data obtained from website cookies to identify users, analyse website visit statistics and user behaviour and improve the quality of the website.

6.4. The User can change the settings regarding the use of cookies (delete/block all or some cookies) by changing the settings of the web browser. 7. DATA STORAGE CONDITIONS

7.1. The data controller stores the user's personal data for the period stipulated by the laws of the Republic of Turkey and other applicable laws and this privacy policy, but not longer than necessary to achieve the data processing objectives specified in this privacy policy.

7.2. The controller processes the user's data as long as the user has an existing profile on the SUPERBAKICI platform. If the user deletes his/her profile on the SUPERBAKICI platform, the controller will store the user's personal data within one month of the deletion of the user's profile. Paid membership data will be stored for five years until the membership expires. In some cases, for example, to resolve disputes or in other cases, personal data may be stored for a longer period.

7.3. The controller shall not store irrelevant and outdated personal data, and if the user updates the data in his account, the old information shall be replaced with new information. Historical information shall not be stored for longer than necessary if it is necessary for legal proceedings or for the controller to carry out its activities.

 

8. USERS' RIGHTS

8.1. By using the website, users have the following rights:

8.1.1. Knowing which personal data is used and for what purposes;

8.1.2. Access to your personal data;

8.1.3. Request correction or addition of personal data if it is incorrect or irrelevant.

8.1.4. Request the erasure of personal data (right to be forgotten);

8.1.5. Request the controller to limit the use of the user's personal data;

8.1.6. Request the transfer of data to another data controller (right of transfer).

8.2. The user has the right to submit all requests regarding the privacy policy in writing to the data controller using the contact information provided at the end of this privacy policy.

8.3. The user must provide his/her identity document or identify himself/herself using the electronic communication tools permitted for use when making the request.

8.4. The controller shall respond to the user's request and perform the actions specified in the request or shall refuse to perform them no later than 30 days from the day the request was submitted, indicating the reason for refusal. Taking into account the complexity of the requests, the specified period may be extended by two months. In this case, the data controller shall inform the user of the relevant extension and provide the reasons for the delay.

8.5. If the user requests the deletion of his/her personal data, the data controller is obliged to delete them if the request is based on at least one of the following reasons:

8.5.1. Personal data are no longer necessary to achieve the purposes for which the data were collected or otherwise managed;

8.5.2. The user withdraws consent to the processing of his personal data and there is no other legal basis for the processing of the user's personal data;

8.5.3. The User does not agree to the data processing if the legitimate interests of the data controller are the basis for this and the data controller does not provide better legitimate grounds for further data processing;

8.5.4. Personal data has been processed illegally;

8.5.5. Personal data must be deleted in accordance with the requirements set by the laws of the European Union and the Republic of Turkey.

8.6. The controller restricts the processing of the user's personal data in the following cases:

8.6.1. the user disputes the accuracy of personal data; data processing is limited to a period during which the data controller checks the legitimacy of personal data;

8.6.2. The processing of personal data is unlawful and the user refuses to delete personal data, but instead wishes to limit the use of the data;

8.6.3. The controller does not need personal data for the purposes specified in the fourth section of this privacy policy, but the user needs the data to claim, exercise or protect his legal rights.

8.6.4. The user has objected to the processing of personal data based on the legitimate interests of the controller; the processing is limited until it is checked whether the legitimate rights of the controller outweigh the reasons of the user.

8.7. If the user exercises his/her right to delete or restrict data, access to the SUPERBAKICI platform may be impossible or limited.

8.8. If the user exercises his right to data transfer, he may request the responsible processor to send his personal data directly to another personal data processor, if technically possible.

8.9. The controller has the right not to fulfill the user's requests, except for the request to reject direct marketing offers and the request to resolve the dispute out of court, if it is obliged to ensure: (i) fulfillment of legal obligations imposed on the controller ; (ii) prevention of public order or crime; (iii) protection of the rights and freedoms of users or others; or (iv) other cases provided for in paragraph 1 of Article 23 of the Regulation. In any case, the controller refusing to fulfill the user's request must indicate the reasons for the refusal.

8.10. If the user realizes that his/her data has been processed illegally or a dispute arises with the data controller, the user has the right to resort to the out-of-court resolution institution in Turkey at any time, using the procedure shown on the website of the Data Protection Inspectorate at www.kvkk.gov.tr 

 

9. CHANGES IN PRIVACY POLICY

9.1. The controller has the right to update and change the provisions of this privacy policy.

9.2. If significant changes are made to the privacy policy, the responsible person has the right to inform the user about the relevant changes through the specified contact information and/or the website. The published privacy policy shall change shall enter into force within five working days after it is published on the website or sent to users by e-mail. The change shall apply to all users who do not express their disapproval of the change within the specified period.
